Rights the statute grants each resident

Section 242.501 of the Health and Safety Code directs the licensing agency to adopt rules preserving a list of resident rights and requires each institution to implement them. The list includes the right to be free from physical and mental abuse, the right to be free from chemical or physical restraints except as authorized in writing by a physician for a specified period or in an emergency, the right to have a guardian or family member place an electronic monitoring device in the resident's room, and rights concerning notice, records and complaints. A death claim frequently begins with which of those rights was documented as exercised or denied.

Consent for psychoactive medication is separately regulated

Section 242.505 addresses the administration of psychoactive medication to a resident, including the consent requirements and the information the facility must provide. Where sedation, falls or aspiration figure in a death, the medication administration record, the physician orders and the consent documentation are the primary evidence rather than the incident narrative written afterward. Care plans, weight and hydration logs, wound assessments and staffing schedules complete the picture, and each is a distinct document request.

Chapter 74 treats the facility as a health care provider

Section 74.001 of the Civil Practice and Remedies Code defines health care institution and health care provider, and nursing homes fall inside those definitions. The practical consequence is that a claim over a fall, a pressure injury, an elopement or a medication error is a health care liability claim. That brings the section 74.051 pre-suit notice with its 60-day period and 75-day tolling, and the section 74.351 expert report due within 120 days of each defendant's answer, with one possible 30-day cure period.

The caps that apply to a facility death

Section 74.301 limits noneconomic damages to $250,000 per claimant against a single health care institution, with a $500,000 aggregate where more than one institution is liable. Section 74.303 limits all damages in a wrongful death or survival action against a physician or health care provider to $500,000 per claimant, indexed to the CPI-W from August 29, 1977, while exempting necessary medical, hospital and custodial care expenses. Where the resident's own pre-death suffering is at issue, the survival claim under section 71.021 carries it.

Records, and the authorization a family can sign

Section 74.051(d) requires a provider to furnish unaltered copies of requested records within 45 days of a request. Subsection (e) confirms that a request for a deceased person's records is valid where the authorization is signed by a parent, spouse or adult child, which resolves the question families most often get stuck on when a facility declines to release a chart. Requesting the complete record, including the electronic audit trail, rather than a summary is the practical difference between a usable file and a curated one.

The examiner's jurisdiction reaches recent admissions

The Travis County Medical Examiner's FAQ states the office accepts deaths occurring less than 24 hours after admission to a nursing home, along with unexpected deaths and deaths from unnatural causes, under the article 49.25 categories. That means a death shortly after a transfer between facilities may generate an independent investigation. The office's fee schedule lists $25 for an autopsy report, $5 for an investigation of death report and $50 to certify a record, and its records page explains the request route.

Deadlines, and the estate question behind them

Section 74.251 sets a two-year health care liability period, and section 16.062 suspends limitations for twelve months after a death, or until an executor or administrator qualifies within that window. Because a survival claim usually requires a representative, the county's statutory probate courts often become part of the timeline. This page is general information, not legal advice, and it assesses no facility or resident; that discussion belongs with the attorney advertising on this site.

A survival action can be separate from wrongful death

Texas Civil Practice and Remedies Code section 71.021 says a personal-injury cause of action does not abate because the injured person died and survives to the heirs, legal representatives, and estate.

Why it matters: A death-related review may need to distinguish the family's losses from an injury claim that belonged to the person who died. The records and estate questions can differ.

Austin has a local civil-court process

Travis County lists its Civil and Family Courts at 1700 Guadalupe Street in Austin. Its District Civil Courts have original jurisdiction over civil matters involving damages of $200 or more, and the District Clerk says attorneys must e-file civil documents.

Why it matters: Death-related civil matters require attention to local filing, service, record, and scheduling procedures rather than informal paperwork alone.

Fatal crashes are a documented Travis County issue

TxDOT's 2024 Crashes and Injuries by County table reports 139 fatal crashes and 155 traffic fatalities in Travis County.

Why it matters: A fatal-crash review may need to preserve crash reports, vehicle information, witness material, video, and insurance communications before the record becomes harder to reconstruct.
