Who May Bring a Wrongful Death Claim in Austin, TX Beneficiaries, Estates and Court Filing

Texas hands the death claim to a short list of relatives and stops there. Understanding which name belongs on a petition, and what happens after three calendar months of silence, comes before any question about value.

The statute names three classes and closes the list

Section 71.004(a) of the Civil Practice and Remedies Code says the action is for the exclusive benefit of the surviving spouse, the children and the parents of the deceased. Subsection (b) then allows one of those individuals, or all of them together, to bring it for the benefit of everyone entitled. That structure surprises families in two directions at once. A single grieving parent can protect the whole claim without waiting for agreement from an estranged sibling. And an adult brother who handled every arrangement, paid the funeral home and answered the county's calls holds no beneficiary status of his own under this chapter.

The threshold question sits in section 71.003

Before any of that matters, section 71.003(a) applies the subchapter only where the injured individual would have been entitled to bring an action for that injury had they lived or been born alive. A defense that would have defeated the injury claim can therefore defeat the death claim built on it. Subsection (b) confirms the chapter reaches an injury occurring outside Texas, and subsection (c) carves out claims for the death of an unborn child brought against the mother or against a physician performing a lawful procedure with the required consent.

After three calendar months the duty moves

Subsection (c) of section 71.004 is the provision families almost never hear early. Where none of the spouse, children or parents has begun an action within three calendar months after the death, the executor or administrator of the estate shall bring and prosecute it, unless every one of those beneficiaries requests that it not be filed. This is not a bar that erases anyone's rights at ninety days. It is an affirmative duty landing on whoever represents the estate, which is one reason the probate question and the liability question tend to arrive on the same desk.

What a defendant may not raise about a widow or widower

Section 71.005 is short and unusually blunt. Evidence of an actual ceremonial remarriage of the surviving spouse is admissible if it is true. The defense, however, is prohibited from directly or indirectly mentioning or alluding to a common-law marriage, an extramarital relationship, or the marital prospects of the surviving spouse. Families frequently brace for exactly that line of attack. The statute forecloses most of it, and the boundary is worth knowing before anyone gives a recorded statement about their personal life.

Recovery arrives as shares, not as a family fund

Section 71.010 lets the jury award an amount proportionate to the injury resulting from the death and then divides that award into the shares the jury finds among the entitled individuals who are alive at the time. Each share stands on its own proof. Section 71.011 adds a protection that matters where an estate is insolvent: damages recovered under the subchapter are not subject to the debts of the deceased. A separate claim, the survival action under section 71.021, belongs to the heirs, legal representatives and estate instead, and it does not follow the same beneficiary list.

Filing in Travis County does not mean drawing a judge

Local practice here has a feature that catches out-of-town counsel. Travis County's civil district courts run a central docket: under Local Rule 1.3 the District Clerk files cases by distributing them equally on a rotating basis among the district courts, yet hearings and trials are assigned to available judges without regard to the court in which the case was filed. The rule states plainly that the court number in the style of the case does not mean the judge of that court will conduct the hearings or trial. Those civil and family courts sit at 1700 Guadalupe Street, and the county's two statutory probate courts handle the estate side, including lawsuits by or against a personal representative.

A nonresident estate and an out-of-state death

Two provisions handle families who do not live here. Section 71.012 says a foreign personal representative who has met the Estates Code chapter 503 requirements for probating a foreign will need not apply for ancillary letters testamentary to bring the action. Section 71.031 allows a death or injury caused by an out-of-state act to be enforced in Texas courts where a law of that place or of Texas gives the right, and where the suit is begun inside the Texas period and, for a resident of the other state, inside that state's period as well.

Where this page stops

This is background on how chapter 71 allocates a Texas death claim. It is not legal advice, and it does not decide whether any particular relative is a beneficiary of any particular claim. Those questions turn on records, dates and family facts, and they belong with the attorney who advertises on this site.

Jury-docket cases are automatically referred to mediation

Local Rule 13.3(a) automatically refers all cases set for trial on the jury docket or the non-jury long docket to pre-trial mediation, and Local Rule 8.1 makes cases on file over 18 months with no trial setting and no filings in 180 days eligible for dismissal for want of prosecution.

Why it matters: A Travis County death case is usually tested at mediation before trial, and a filed case can still be dismissed on the court's own motion if it sits idle.

Austin recorded 99 traffic deaths in 2025

The City of Austin reports 99 traffic fatalities and 301 serious injuries in 2025, with pedestrian deaths falling from 39 to 30, and estimates that roughly 65 to 75 percent of Austin traffic fatalities occur on state-owned roads.

Why it matters: Road ownership decides which entity is a potential defendant and which notice deadline applies, and the city's 45-day charter claim period is far shorter than the six-month statutory default.

Construction accounted for 23 percent of Texas work deaths in 2024

The Texas Department of Insurance counted 557 fatal work injuries statewide in 2024 at a rate of 3.9 per 100,000 full-time equivalent workers, with 128 construction incidents, about 23 percent of the total, and construction or maintenance sites making up 15 percent of fatality locations.

Why it matters: A construction death in an area under active highway reconstruction usually involves several contractors, and chapter 95 requires both retained control and actual knowledge before a property owner is liable.
