Smoke alarms are a statutory duty, not a courtesy

Subchapter F of chapter 92 of the Property Code governs smoke alarms in rental housing. Section 92.251 opens the subchapter, and section 92.258 requires the landlord to inspect and repair a smoke alarm in accordance with the subchapter. Section 92.259 sets out the landlord's liability where the duty to install, inspect or repair is not met after the tenant's request, and section 92.260 preserves other rights and remedies. After a fatal fire, the alarm history, the maintenance ticket record and the written requests in the file become central evidence.

Written notice, and what it starts

The remedies in this subchapter are structured around a tenant's request and the landlord's response window, which is why the surviving family's copies of maintenance requests, portal tickets, emails and dated letters matter so much. Verbal complaints to an on-site office are the hardest facts to prove after the fact and the easiest to dispute. Where a unit changed hands, the prior management company's records may hold the notice that the current company's system does not.

An ordinary premises claim still has to be proved

Outside the smoke alarm provisions, a death on residential property is analyzed as a premises case: what the condition was, how long it existed, what the owner or manager knew or should have known, and what was done about it. Lighting, gate and lock function, stair and railing condition, pool access, balcony structure and prior similar incidents at the property are the usual subjects. Work orders, vendor invoices, inspection reports and prior complaint logs establish the timeline. Those records sit with the management company and its vendors, not with the family.

Comparative responsibility applies here too

Section 33.003 requires the trier of fact to assign percentages of responsibility in whole numbers among claimants, defendants, settling persons and designated responsible third parties. Section 33.001 bars recovery only where the claimant's percentage exceeds 50 percent, and section 33.013 generally limits each defendant to its own share. A third party who caused the death, such as an assailant or a contractor, may be designated, which redistributes percentages rather than eliminating the premises claim.

Public housing and public property change the analysis

Where the property is owned or operated by a governmental unit, chapter 101 governs. Section 101.056 keeps discretionary decisions outside the waiver, section 101.023 caps recovery, and the deadline shortens sharply: section 101.101(b) ratifies a shorter charter period, and the City of Austin's claim instructions require a written claim within 45 days of the incident describing the date, location, occurrence and damages.

Who brings the claim, and the estate's separate one

Section 71.004 confines the death claim to the surviving spouse, children and parents and, after three calendar months of inaction, obliges the executor or administrator to bring it unless all beneficiaries request otherwise. Section 71.021 carries the deceased person's own injury claim to the heirs, legal representatives and estate. Where the Travis County Medical Examiner investigated, that office holds records obtainable separately from the fire or police file.

One caution about local statistics

No figure describing Austin's rental housing stock or apartment population appears on this page, because no primary source for one was verified in preparing it. This page is general information about Texas premises and rental-housing law, not legal advice, and it evaluates no property and no death. The attorney who advertises on this site is the appropriate person for a specific question.

Jury-docket cases are automatically referred to mediation

Local Rule 13.3(a) automatically refers all cases set for trial on the jury docket or the non-jury long docket to pre-trial mediation, and Local Rule 8.1 makes cases on file over 18 months with no trial setting and no filings in 180 days eligible for dismissal for want of prosecution.

Why it matters: A Travis County death case is usually tested at mediation before trial, and a filed case can still be dismissed on the court's own motion if it sits idle.

Austin recorded 99 traffic deaths in 2025

The City of Austin reports 99 traffic fatalities and 301 serious injuries in 2025, with pedestrian deaths falling from 39 to 30, and estimates that roughly 65 to 75 percent of Austin traffic fatalities occur on state-owned roads.

Why it matters: Road ownership decides which entity is a potential defendant and which notice deadline applies, and the city's 45-day charter claim period is far shorter than the six-month statutory default.

Construction accounted for 23 percent of Texas work deaths in 2024

The Texas Department of Insurance counted 557 fatal work injuries statewide in 2024 at a rate of 3.9 per 100,000 full-time equivalent workers, with 128 construction incidents, about 23 percent of the total, and construction or maintenance sites making up 15 percent of fatality locations.

Why it matters: A construction death in an area under active highway reconstruction usually involves several contractors, and chapter 95 requires both retained control and actual knowledge before a property owner is liable.
