When a death follows treatment, two claims can arise from one chart. One belongs to the family. The other belongs to the estate, and it usually cannot move until a probate court has appointed somebody to hold it.

Six boxes, about thirty seconds. You pick when to be called back, and that is when the phone rings.
Or call (512) 729-9561The family's claim rests on section 71.004, which limits it to a surviving spouse, children and parents. The other claim is the patient's own, and section 71.021 keeps it from dying with them, passing it to the heirs, legal representatives and estate. Both are gated by section 71.003(a), which applies the subchapter only where the patient could have brought the injury action had they lived. A death that follows care may also be a health care liability claim under chapter 74, which layers presuit notice and expert-report requirements on top of everything described here.
The survival claim needs a legal representative, and that appointment happens in probate. Travis County runs two statutory probate courts, and the County Clerk's probate division handles the filing procedures, court costs, citations and the issuance of letters. Where there was no will, an application to determine heirship can run alongside the application for administration. None of this decides the medical question. It decides who is allowed to ask it on the patient's behalf.
Section 16.062 suspends an applicable limitations period for twelve months after a death. Read the second sentence too. Once an executor or administrator qualifies, the period begins to run from that qualification, so appointing someone can start a clock rather than pause it. Section 16.001 is the other narrow provision families ask about: time under a legal disability, meaning under eighteen or of unsound mind, is excluded from a limitations period, disabilities cannot be tacked together, and one arising after the period starts does not suspend it.
The Travis County Medical Examiner works under article 49.25 of the Code of Criminal Procedure. That authority reaches unattended deaths, suspicious or unnatural deaths, and deaths where the cause is unknown. It also reaches children under six and deaths occurring less than twenty-four hours after admission to a hospital or another institution. That last category catches many hospital deaths that families assume the office would never see. The examination itself generally takes 12 to 24 hours. The office states that an autopsy report is public information under the Public Information Act unless an exception applies.
Requests go to the office at 7723 Springdale Road, or by mail and e-mail, using the autopsy report request form, which asks for the case number, the decedent's name, the date of death and the requester's relationship. The published fee schedule charges $25 for an autopsy report and $5 per investigation of death report, exempts the county legal next of kin from the autopsy report charge, and charges $50 to certify a record and $30 per disc of digital images. A certified copy is the version that a court file usually needs.
Central Health is Travis County's taxpayer-funded hospital district, created by voters in 2004, and it operates a clinic network across the county. A hospital district is a governmental unit, which puts the six-month notice rule in section 101.101 and the ceilings in section 101.023 in front of the ordinary rules. For a unit of local government other than a municipality those ceilings are $100,000 for each person and $300,000 for each single occurrence. Naming an individual clinician first can also trigger the election in section 101.106 and bar the claim against the district.
Start with the complete chart from each facility rather than a discharge summary, then the medication administration record, the orders, the imaging, the monitoring data and the nursing notes. Add the ambulance run report and any transfer paperwork. Keep a simple log of what was requested, from whom, on what date and what came back. On fees, Rule 1.04 sets no percentage limit and instead requires the written terms and the expense treatment to be spelled out before anyone signs.

Why it matters: A fatal-crash review may need to preserve crash reports, vehicle information, witness material, video, and insurance communications before the record becomes harder to reconstruct.

Local Rule 1.3 of the Travis County civil district courts has the District Clerk distribute filed cases equally on a rotating basis, while hearings and trials are assigned to available judges without regard to the court named in the case style.
Why it matters: The court number on a petition does not identify the judge who will hear a death case, so scheduling in Travis County works through the Court Administrator rather than a single court's coordinator.

Local Rule 13.3(a) automatically refers all cases set for trial on the jury docket or the non-jury long docket to pre-trial mediation, and Local Rule 8.1 makes cases on file over 18 months with no trial setting and no filings in 180 days eligible for dismissal for want of prosecution.
Why it matters: A Travis County death case is usually tested at mediation before trial, and a filed case can still be dismissed on the court's own motion if it sits idle.
